How many of you are old enough to have lived through Watergate era? The Pentagon Papers? The Plumbers? Sometimes the best place to get the truth out is via the media (e.g. The Free Press?) not a government agency. Should this guy have reported to an agency, perhaps, but he ensured that whistle he blew would be heard and not stifled in the furtherance of his Hippocratic oath as a physician.

And, I would like to state, my position is not to give cover to people who blow their national security clearances to do grave harm.

Step outta line the man comes and blows you away. Dr. Hiam is being offered up by the illegitimate regime as a cautionary example to all who will not comply. Keep electing leftists.

The left has re-engineered the nation so that you can apparently now go to jail for revealing that a major medical institution is performing sexual mutilations on children.

And the fact that we have to add that these sexual mutilations are/were illegal makes it all even more insane, implying, as it does, the horrifying truth that such child sexual mutilations are now generally legal.

Furthermore, of course, expressing any doubt or hesitation about the sexual mutilation of children puts you at odds with the prevailing, insane, Orwellian, leftist orthodoxy.

So, even if the totalitarian left can't manage to put you in jail for it, they may be able to ruin your career or even your life.

Utter madness.

Were I a Law Student, or just starting out, I would be spending A Lot of time studying what The Law says about Medical Malpractice and "Gender Affirming Care". Because very shortly you will not be able to swing a dead cat without hitting a lawsuit. Hospitals, Doctors, Org's/NGO's pushing this, Parents, Best be Lawyering Up. Judges also better brush up, cause the tidal wave is coming.

The procedures weren't illegal at the time they were being performed, but the hospital had promised that they wouldn't do them any more.

Thanks, duly noted.

Though, to be clear, I think the fact that the sexual mutilation of children is *ever* legal is the bigger scandal.

I agree with that and your comment in general.

Prosecutors are given wide latitude in bringing charges. Maybe this is a good thing or not.’ We would hope they exercise unbiased decisions in so doing. But this case reeks of attacking whistle blowers bringing child molestation into the light. As such, the prosecutors have brought their sick prejudices to bear. They and their bosses should be fired, and the charges dropped.

Don’t count on the current Attorney General doing this.

It sure is easy to highlight the plight of this fine doctor rather than focus on the malevolence of those who are persecuting him. That's because those persecuting him are Democrats and the people at this publication support Democrats.

This is a serious moment in American Medical history. I sent him money for his case. What is happening with gender transitions is an experiment similar to what happened in the Tuskegee Syphilis experiments, where black men were left to die of syphilis just to see what that looked like. The experiment continued until 1973! Every doctor knew it was happening, but none had the courage stand up to stop it. Harmful pseudo-science is not new. The same was the case with the lobotomy rage in the 40's and 50's. We must protect this brave soul. Opposing such authoritarian power is wildly dangerous. It is our duty to help protect him. In case you think I am exaggerating there were secret nuclear experiment performed on unwitting civilians and only courageous whistle blowers stopped them. https://en.wikipedia.org/wiki/Human_radiation_experiments

First time hearing this?

When discovered in the 70s, these government 'medical professionals' and 'scientists' simply moved their research over to contractors in foreign countries. Still Americans, funded by the US, just in a foreign country.

Then - our government - got caught again in the 90's operating fronts in south and central America.

So, seems they added in some foreign docs and funded other labs after the 90s fiasco to give the appearance we have nothing to do with the research. So Fauci can say what he says legally, while it's apparent he has no ethics.

There are labs funded by you and I in Kenya and Thailand (via WHO) that research the worst wild diseases from those regions. They collect them and play with them in their labs.

And, when caught they just move countries. The Wuhan outbreak should be no surprise; research scientists and medics don't give a shit about anyone but themselves. They are in it for the glory/money, not the science. Since the Wuhan lab is out of the reach of our gov, makes you wonder what has been 'accidentally' released from those Asia/Africa labs that we never heard about.

PS: Worked with one of these NIH lab directors for a while and he was the most arrogant, toxic, self righteous and narcissistic person I've ever met on this planet. Bar none.

This is a true travesty. This man is a mandated reporter of child abuse, the law in his jurisdiction says these practices are illegal, he redacted any identifying information about the patients in his reporting. He is a whistleblower worthy of the protections of the legal system and not being subject to being cudgeled by it!!! Very Alice down the rabbit hole!!! Everything is being stood on its head! Donate to his legal defense, help him get the best lawyer that money can buy - I did!!! Better yet, there are a lot of really great attorneys who could find it in their heart to handle this pro bono!!!

Unfortunately this is a federal case not a state case. Abbott cannot pardon him if convicted. I suspect that Trump, if reelected, would pardon him if convicted. I find it hard to see a Texas jury convicting him.

Despite what the free press says this guy clearly breached HIPPA. Simply redacting a name isn’t enough, the doctor knew better.

That being said i’ve never heard of the government going after someone like this for a HIPPA breach before.

Two things can be true at the same time. He did break the law and the government is unfairly targeting him in an unprecedented manner.

I am a healthcare provider and am required to attend risk management workshops and remain updated on HIPAA and subsequent related legislation. I have been told repeatedly that we must comply with HIPAA, but individual healthcare providers are almost NEVER audited by HIPAA enforcers. Larger systems, such as hospitals, are the most likely targets of audits. Dr. Haim was functioning as an individual employee and doctor when he reported his employer for secretly continuing to put pediatric patients through "gender affirmative care," after the hospital had announced they had stopped. I have never heard of any situation involving any provider or system of providers in which a team of FBI agents aggressively went after an individual doctor for alleged HIPAA violations, let alone when that doctor was acting as a whistleblower. There is no evidence at this point that Dr. Haim "did break a law."

In your risk management trainings they told you to release medical records to the press? Interesting. A reporting requirement would have been to a state agency not the press.

You just don't like the fact that she obviously has been through the training and is spot on.

I have since it was called OCTAVE training. She's entirely correct; NO ONE has ever been pursued like this for a HIPAA violation. Hell, you could walk through any hospital or clinic right now and find serious violations. Docs leave shit lying around exposed everywhere.

This is targeted. The currently reigning political party has implemented total lawfare, not just against their political enemies but any perceived enemies. How many BLM rioters are in jail versus J6 rioters? They both committed the same crimes.

My opinion is this is all Obama - he was the droner in chief, and this skeezy backhanded legal bullshit is just his style.

Read my original comment, I said he broke the law AND hes being unfairly targeted.

The assertion that releasing PHI to the press isn’t illegal is absurd and its strange you guys keep insisting that it isn’t. Especially when invoking HIPAA compliance trainings as justification.

This is truly bizarre

"That guy" keeps us safe too. Please keep being "that guy." It is in exceptional situations like this when the rules become impediments to justice that we need good judges and reasonable juries. Statute law has never been sufficient to guarantee justice. This will be an important legal case as well.

If you work in the health field, I’m sure you know it’s HIPAA not “HIPPA”. One requirement is to redact protected info. There are 18 identifiers, none of which appear to have been included in Rufo’s original article.

Ah yes, you’ve never made a typo excellent. Its also a requirement not to release medical records to the press. A reporting requirement would have been to a state agency not the press.

Expand full comment

You appear to be talking about mandatory reporting of child abuse, which requires contacting a state child protective services department. I made no reference to that reporting requirement. The doctor in this case was acting as a whistle blower regarding the practices of his employer. That is a completely different issue. You also continue to say that the doctor broke a law. This man has not yet been convicted of any crimes.

If he was also bound by a reporting obligation, then "catch 22" seems more accurate than saying two things are true at the same time.

The reporting requirements require supporting data, how was he supposed to do that without running afoul of that HIPPA standard? Cannot allow unsubstantiated reports or the system flooded with nonsense. This doctor did the absolute best he could by removing any identifying information about the individual patients.

I tried to leave a reply. I will try again. I do not know if you lived through Watergate, The Pentagon Papers, or The Plumbers, but sometimes the media may be the best outlet for a whistleblower, particularly when there may be concerns that the “appropriate’ agency is not likely to act. However, that said, I do not condone those who blow their national security clearances to put people in danger.

Perhaps. Here is the gist of a later comment I wrote. I don’t know how many of you are old enough to have lived through Watergate, The Pentagon Paper, The Plumbers? Sometimes the best way a whistleblower can ensure they are heard, at great risk to themselves, and not squelched by the very agency that is supposed to be overseeing the asylum is to go the media (like The Free Press?). I do not for one moment however, condone blowing national security clearances when doing so.

This strikes me as an ideal case for Jim Jordan's committee on the weaponization of government. So much that committee does is trivial nonsense. But this is a case where a physician exercised his "do no harm" oath in good faith and is being targeted by the DOJ for punishment. Seems like ideological weaponization to me.

Going after whistleblowers and political enemies is just the norm for the US now. I remember it starting with Chelsea Manning, Edward Snowden, and had pressure put to have it done to Julian Assange. But I assume it's been going on a lot longer than that.
