This guy is no victim. If under the law producing porn is considered constitutionally protected speech, which I am uncertain if that is even the case, it still wouldn’t stop your employer from being well within their rights to fire you.

I could stand on the sidewalk politely saying the N word to people as they walk by. It would be protected speech. The police couldn’t arrest me for saying the N word and I wouldn’t be causing a scene that could be considered disorderly conduct.
But my employer could sure as hell fire the werido guy that says racial slurs to strangers downtown.
Well I’m self employed… but the point remains, I wouldn’t be a victim if my legal but undesirable behavior negatively impacted my life.
This isn’t a free speech issue. Its a debate around whether we should have any sort of morals and standards of conduct in our society.

I have a problem with your analogy. Calling people the N word is not the same as having sex with your wife. Employers should mind their own bees wax.
