We seem to forget that the nomination process includes several factors, aside from a presidential nod. Efforts can be made to thwart this or any other nominee. Just as Biden announced he would nominate a Black woman, he could have kept silent, and just nominated one. He chose to stir the pot instead.

Following a nomination, there is the Senate weighing in. They will question the nominee (s), and investigate. As we have seen in the past with Gorsuch and Kavanaugh, there is always "dirt" alledged to a candidate. There was some of that happen to Justice Clarence Thomas, though they all were successful.

In 2017, we changed the need for the Senate votes to allow for a simple majority, but I hope partisonship will, more clearly, define the ideas of what a Supreme Court Justice should be: The best of the best, regardless of gender or race.

The most important part of this whole episode is that it takes place within the confines of an alleged institution of higher learning, a university supposedly designed to teach people to learn, grow and think.

Well, I see now that Professor Shapiro has been purged from the faculty of Georgetown Law. Po-mo progressive fascism strikes again. Meanwhile, Whoopie Goldberg has been suspended from "The View" for her anti-Semitic Holocaust rant—no doubt to deprive conservatives of some particularly ripe low-hanging fruit. For I doubt that any true progressive was disturbed by the content of her screed. After all, it came straight out of the intersectionality handbook. Still, loathsome as she is, those of us who defend Illya Shapiro must also defend Whoopie Goldberg. She has a right to be loathsome, after all, and other people have said, on the air, similarly disgusting things about Jews, conservatives, parents, etc. and gotten away with it.

Bari - i look forward to every post. Reading your substack is well worth the piddly amount i paid to subscribe. Conclusion after reading? Twitter remains the biggest piece of garbage American companies ever invented. We.d all be better off going and eating nothing but McDonalds for a year before staying on that gross “platform” even if it took years off our lives

What Georgetown Law did to professors Sandra Sellers and David Batson was horrid. This happened less than 1 year ago and it falls into the same category, speaking honestly about real issues.

One (Sellers, IIRC) spoke about her concern that her black students tended to score low in her courses. The other listened. The conversation lasted under a minute. Both profs were sent packing (one fired, the other technically resigned, but it was clearly forced).

These were concerned professors. They were discussing a perceived and possibly real problem. Something genuinely worthy of a legit investigation.

But we can't have that sort of honest investigation. Not at Georgetown Law. Because if they found the problems considered by Batson and Sellers, they'd be forced to admit they did not have equality of result. Rather than risking getting a result which might be problematic, they effectively fired two qualified professors.

For everyone's sake, it would have been better to figure out if the issue had merit. If it had merit, finding the underpinnings of it so it could be addressed.

Georgetown Law got rid of honest and well-intended professors. It was a cover up.

So it should not come as any surprise we see another recurrence of this at Georgetown Law. Far better to silence specific voices than to actually risk learning something.

The outcry is mostly because of the "lesser black woman" part of his tweet.

The left hates this insinuation, they hate the whole concept of the label "diversity hire."

But if race is used as a qualification then the other things that matter (skills/talents, past performance, merit) must by definition be lower than those from non favored races.

A rational response to a culture filled with "equity hires" is to assume that those given points due to race are less qualified for the job. Asian vs. black admission to Harvard (as clearly shown in the ongoing lawsuit) bears this out when looking at test scores. Harvard knows this, as does the rest of higher education, so they are eliminating standardized testing as part of their admission criteria. Easiest way to keep on discriminating is to get rid of the evidence that you are doing so.

When choosing a doctor or lawyer or mechanic or accountant, in a system that has fully embraced the concept of "equity," a logical person would look at race as an mark of inferior ability.

Racial discrimination begets racial discrimination. It's axiomatic.

There’s a distinct possibility that your whole premise is racist. It’s distinctly possible that there are many qualified candidates, that Biden is taken into consideration, note the word consideration, appointing a black woman. Qualified doesn’t necessarily mean the highest score; there are multiple considerations.

Look at whatever qualifications you want, just stop the racial discrimination. Higher education doesn't want to stop, so they are getting rid of qualifications that expose their racism. I wonder if grades are next?

If there are highly qualified black women that would make good Supreme Court justices, than just nominate one, point to her record and be done with it. I would be pissed at Biden if I were the black woman he picks, she'll have to live with "best available black woman for the job" rather than best available legal mind for the position.
