I'm not sure about NY law, but here under DC law, Neely committed assault when he threatened to physically harm people on the car - a death threat - and threw down a piece of his own clothing - adding physicality to the verbal threat. The legal definition of assault is to threaten violence. (The actual violence is legally battery) Neely's threat was a crime in and of itself, against Penny and everyone else in the subway car, and Penny's response was legally self-defense. The only question seems to be whether he used unreasonable force.
All I can say is thanks. The reactions on the police body cams show that the passengers were in fear of their lives. If Penny is convicted it will be another star in Soros’ perverted cap for destroying the justice system. At least in California we got rid of three of the loons who infested DAs offices.
Hmm. I watched and listened closely for the "racism" element. I didn't see it. On the contrary I saw 2 brown skinned men assisting Perry by taking control of his left and right arms. I saw 2 black eyewitnesses who claimed Neeley was threating. There was no comment from them regarding racism. There appeared to be many by-standers with in 15 to 20 feet of the incident. I heard no cries of "stop it", "you're killing him', "racist" or any cries of concern for Neeley. It seems to me, to call someone racist without any evidence of racism, is the real racism.
I watched the police interrogation and this gut penny talked to them without an attorney and just told them what happened.
Now I am not a jurist nor a lawyer but if this Penny did this maliciously the verbiage with the police is totally inconsistent with the conversation .

You are innocent until proven guilty. It seems there has been a lot of public opinion by outsiders like AOC and the Reverand Al Sharpton who have found him guilty before there was even a trial.
Not having all the testimonies before us it would be impossible to say much more.
If the victim was a white person I doubt there would even be a trial.
But the current divisivenesss in this country leads me to believe that this is like a lynching from the Jim Crow era except they have video footage of exactly what happened and testimony by experts (but experts are always paid and biased so you can't really rely on their testimony unless they coincided with their conclusions which obviously they did not.)
We also don't know if the jury was sequestered the whole time as the media has been full of this story from day 1 I am sure.
Also what is the makeup of the jury and do you need only one person to find him innocent in this type of trial or is it a majority or what. I am not a lawyer.
Overall we will know next week and regardless of the outcome, you can be sure there will be comments from both sides.
I believe this incident was not one of a white supremicist wanting to carry out a malicious act. I understand that this guy was an architectural student going to class and has no background in racism from what the FP has stated.
And I think it was a tragic event but if there were drugs in his system, and if he had SS trait then he was compromised. What were all his convictions for?
Why wasn't he on medicine for schizophrenia?
Was he a danger to the Public previously?
Why was he homeless?
His childhood is a tragedy but the medical system is partially at fault as there should have been care for ths mentally disabled person or a facility for him.

What is amazing is that the left leaning press all jumped on Tucker Carlson when he remarked that the subways looked great in Moscow. As a New Yorker I am always struck by the subways in other countries that look vastly better than ours and don’t do double duty as insane asylums.

The voices of those pictured and quoted politicians and talking heads who claim that Penny was a racist are just echoes of their usual and past pronouncements. Their careers are seem to be greatly intertwined with the race factor. Neely's history is sad and probably a condemnation of our mental health system. Penny's history does not portray a racist. The NYC medical examiner appears to have problems with competency and professionalism. There should have been no criminal proceedings in this matter. The DA apparently prizes his political agenda over justice. Neely's death is tragic and Penny's indictment is unjust. What this trial will do is to confirm most folks instinct "not to get involved."
I don't think it's "confirming" an existing instinct to not get involved. I think it's SCARING people to not get involved for fear of what Penny is going through being tried. ALREADY there was the risk of getting badly hurt if you step up to stop a crime, but now? Forget it, no way, not worth that added risk -
